Let's speak about the features we'd like to have in next demo (I'll quote from JGG Forum):
/allowdemoplayers <0|1|2..> (Yes, No, Yes but switch to spectator the last one that came when a licensed player comes and server is full, Yes only spectating, etc)
/mutespectators <0|1|2..> (Yes, No, Yes but only if they are demo players, etc)
- permission to drive at all tracks and servers (if server is full, demo players are kicked or switched as spectators when a full player joins)
- no permission to build tracks (& tiles & terrains)
- changing car colors (and only grey demo-players)
- no statistics and records (logs, race recording, stats and laps saving etc..)
- having an own name (they could be named like demo001 etc when playing online)
Another thing you should try to do, is to make a "master server" for cups&tournaments, in which everyone can post his cups. Remember that MANY players are buying licenses in order to join a tournament (like Punaball 2vs2 World Cup or Punaball 2vs2 Open Tournament/Six Nations -> http://www.ippon-team.com ).
I know that those things could be hard to realise and could take a lot of time, so this is what we need first:
- demo players should be allowed to spectate a full-online race (maybe with a command like /maxdemospectators <..> in order to avoid big lags due to many spectators connected)
- automatic switching to spectator when entering a full server (many players don't know how to change from user to spectator)
- possibility to manage spectators (/kick /ban /mute)

An idea that I would like included in a future version would be for team games like punaball.
Sometimes in a game I would like to send a message to my teammate only for such things as strategy and to point out enemy tendencies.
Is it possible to have another "t" key that sends the text in game to only my partners? I have played a different game that when I hit semicolon instead of t, my message would only go to my teammates.

Like you said, the first scheme would require lots of work both to make and to maintain, but in theory, it could be a good system. On the other hand, it could also divide the community (it would require a version that is not downward-compatible with older versions) and make it easier to make cracks. It might also be that many casual players would just find it good enough to play as guest. It would be interesting to know, for example, how many Soldat players buy the game...
I can think about spectator issues more, yes. In fact, the current spectator system is a kind of by-product of other things and has never been given much thought. One problem is that each spectator increases the bandwidth requirement but like you said, it could help if there was a maximum amount of spectators allowed. Anyway, I recognize the need to consider other demo systems. Unfortunately, I have a limited amount of time to use and most of it is right now going to maintaining existing things. There are new players coming all the time but it is unfortunate if it does not show in the public servers.
